Legal & compliance
Website Terms & Conditions
These terms govern your use of the Rent Direct Hub website and services. By using the platform, registering an account, listing a property or contacting a landlord, you agree to them.
Draft document — not yet legally reviewed
This document is a working draft and has not yet been reviewed by a South African legal or compliance professional. Publishing these pages does not on its own make the business compliant with POPIA, PAIA, ECTA or the CPA.
1. Who we are and our role
Rent Direct Hub is operated by HMR PROPERTY SOLUTIONS (PTY) LTD. We provide an online marketplace that connects private, self-managed landlords directly with tenants, plus tools to help landlords manage their own listings and a directory of property service providers.
We are a platform, not an estate agency, letting agent, managing agent or party to any lease. Any lease, deposit, viewing arrangement or payment is a matter between the landlord and the tenant. We do not inspect properties, hold deposits, collect rent or provide legal, financial or property advice.
2. Eligibility and registration
- You must be 18 or older and legally able to contract.
- Landlords must register an account. Tenants may browse and contact landlords without an account.
- Registration information must be true, accurate and kept up to date.
- One person or entity may not create accounts to impersonate someone else or evade a suspension.
3. Account security
You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at Rentdirecthub@hmrprop.co.za if you suspect unauthorised access. We may suspend an account where we reasonably believe it has been compromised.
4. Listings and landlord responsibilities
- You may only advertise a property you own or are lawfully mandated to advertise.
- Listing details — rental amount, deposit, address or suburb, size, features, availability and photographs — must be accurate, current and reflect the actual property.
- Photographs must be of the actual property and you must have the right to use them.
- You must remove or mark a listing as unavailable once it is let.
- You must comply with all applicable law, including the Rental Housing Act 50 of 1999, the Consumer Protection Act 68 of 2008 where applicable, POPIA, municipal by-laws and any body-corporate rules.
- You may not unfairly discriminate against prospective tenants on any ground prohibited by the Constitution or the Equality Act.
- You are responsible for screening tenants, concluding a lawful lease and handling deposits in accordance with the law.
5. Verification badges and what they mean
Verification badges reflect limited checks we have carried out at a point in time. They are not a guarantee, endorsement, warranty or recommendation of any person, property or transaction.
- Identity Verified — a landlord submitted an identity document and it appeared consistent with the account name at the time of the check.
- Contact Verified — the landlord's mobile number and email address were confirmed as reachable and controlled by the account holder.
- Property Verified — a document linking the landlord to the advertised property, such as a municipal account, title deed or written mandate, was submitted and reviewed.
Circumstances change and documents can be falsified. Always view a property in person, confirm who you are dealing with, insist on a written lease and never pay a deposit before you are satisfied the landlord and property are genuine. See What does verified mean?
6. Tenant enquiries
Tenants may search and contact landlords free of charge and without an account. Enquiry details you submit are sent to the relevant landlord, who becomes responsible for that information. Enquiries must be genuine — do not use the platform to send spam, solicit business or harvest contact details.
7. Service providers
Service providers listed in our directory are independent businesses. We do not employ, supervise, license or guarantee them, and any agreement is concluded directly between you and the provider. Providers must hold the qualifications, registrations and insurance their trade requires and must describe their services accurately.
8. Prohibited conduct and content
- Fake, duplicate, misleading or bait listings, or advertising a property that is not available.
- Fraud, advance-fee scams, phishing, or requesting payment before a genuine viewing and lease.
- Unlawful, defamatory, harassing, discriminatory, obscene or infringing content.
- Scraping, bulk downloading, reverse engineering, or using automated tools against the platform.
- Circumventing security, interfering with the service or introducing malicious code.
- Using contact details obtained through the platform for unrelated marketing.
9. Your content and intellectual property
You keep ownership of the photographs, descriptions and other content you upload. You grant Rent Direct Hub a non-exclusive, royalty-free licence to host, display, resize and promote that content for the purpose of operating and marketing the platform. You warrant that you own or have permission to use the content and that it does not infringe anyone's rights.
The Rent Direct Hub name, logo, design, text and software are owned by us or our licensors and may not be copied or used without written permission.
10. Moderation, suspension and termination
We may edit, decline, unpublish or remove any listing or content, and suspend or close an account, where we reasonably believe these terms or the law have been breached, or to protect users. Where practical we will give reasons and an opportunity to correct the issue. You may close your account at any time; provisions that by nature survive termination will continue to apply.
11. Availability of the platform
We aim to keep the platform available but do not guarantee uninterrupted, error-free or secure access. Features may be changed, suspended or withdrawn, and maintenance may cause downtime.
12. Third-party links and services
The platform may link to third-party websites, maps, messaging services or tools. We do not control them and are not responsible for their content, availability or privacy practices.
13. Advertising packages and payments
Paid advertising is charged in South African Rand and is displayed inclusive of any applicable amounts before you confirm an order. Card payments are processed by Paystack, an independent third-party payment processor. Rent Direct Hub never receives or stores your full card number or card security code.
Refund and cancellation terms for paid advertising are set out in the Payments & Advertising terms.
14. Disclaimers
The platform and its content are provided "as is". To the maximum extent permitted by law, we do not warrant the accuracy, completeness or legality of listings, landlord or tenant information, service-provider information or any user content. Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or other law that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, Rent Direct Hub, its directors and employees are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of data, or loss arising from a lease, deposit, payment, viewing, dispute or dealing between a landlord, tenant or service provider. Where liability cannot lawfully be excluded, our total liability is limited to the amount you paid us for the service in the three months before the claim arose. This clause does not exclude liability for gross negligence, fraud or anything that may not lawfully be limited.
16. Indemnity
Subject to applicable law, you indemnify Rent Direct Hub against claims, losses and reasonable legal costs arising from your listings or content, your breach of these terms or the law, or your dealings with another user.
17. Privacy and cookies
Personal information is handled in accordance with our Privacy Policy and Cookie Policy, which form part of these terms.
18. Complaints and dispute resolution
Report scam listings, inaccurate information or misconduct to Rentdirecthub@hmrprop.co.za. We will investigate and respond. If a dispute cannot be resolved directly, the parties will attempt mediation in East London before litigation, save for urgent relief. Nothing prevents a consumer approaching the National Consumer Commission or another competent body.
19. Governing law and notices
These terms are governed by the law of the Republic of South Africa and the parties consent to the jurisdiction of the Magistrate's Court having jurisdiction. Legal notices to us must be sent to Rentdirecthub@hmrprop.co.za. Notices to you will be sent to the email address on your account.
20. Changes to these terms
We may update these terms as the platform develops. The version number and date at the top of this page will change and registered landlords will be notified of material changes. Continued use after a change means you accept the updated terms.
