Draft document — not yet legally reviewed
This document is a working draft and has not yet been reviewed by a South African legal or compliance professional. Publishing these pages does not on its own make the business compliant with POPIA, PAIA, ECTA or the CPA.
1. Our role
- We provide a website and account tools that let property owners advertise rentals directly and let tenants find and contact them.
- We are not an estate agency, property practitioner, managing agent, letting agent, rental mediator or insurer, and we do not act for either party.
- We are not a party to any lease, application, mandate or service agreement formed between users.
- We do not receive, hold, transfer or guarantee rent, deposits or any payment between a landlord and a tenant.
- We may moderate, verify, suspend or remove content. Doing so does not make us responsible for the underlying transaction.
2. Landlords
- You confirm you are the owner or are lawfully authorised to let the property.
- You are responsible for the accuracy of the listing: address, rent, deposit, availability, size, features and photographs of the actual property.
- You are responsible for compliance with the Rental Housing Act, municipal by-laws, sectional title or body corporate rules, health and safety obligations and the Consumer Protection Act where it applies to you.
- You are responsible for lawful, non-discriminatory screening and for your obligations as a responsible party under POPIA in respect of applicant and tenant information you collect.
- You decide whether to accept an applicant. We never approve, reject, score or recommend a tenant.
3. Tenants
- Browsing and contacting landlords is free and does not require an account.
- You are responsible for verifying the property, the person you are dealing with and any document before paying anything or signing anything.
- Never pay a deposit, holding fee or rent before you have viewed the property and satisfied yourself that the landlord is genuine.
- You are responsible for the accuracy of the information you give a landlord, and for your own obligations under any lease you sign.
4. Rental properties and listings
- Listings are advertisements supplied by users. They are not offers, valuations, inspections or condition reports by us.
- We do not visit, measure, value, inspect or certify any property.
- Verification badges mean only what the “What does verified mean?” page says they mean.
- We may remove a listing that appears inaccurate, unlawful, duplicated or misleading.
5. Rental applications
- An application made through or after contact on the platform is between the applicant and the landlord.
- The landlord decides what supporting information to request, and must collect only what is necessary and keep it secure.
- We do not carry out credit checks, affordability assessments, employment checks or background screening, and we do not supply any such report.
- No application creates a lease until the landlord and tenant agree and sign.
6. Leases and lease-related information
- Any lease is concluded directly between landlord and tenant. We are not a party, witness, guarantor or record-keeper of that lease.
- We do not draft, review, approve or supply legal advice on leases, addenda, notices or cancellations.
- Template or informational material on the platform is general information, not legal advice. Obtain independent advice before signing.
- Deposits must be handled by the landlord as the Rental Housing Act requires. We never hold a deposit.
7. Rental and payment information
- Rent amounts, escalations, invoices and receipts recorded on the platform are entered by the landlord for their own record-keeping.
- Any figure shown is a record of what a user entered, not confirmation that money was received.
- Rent is paid directly between tenant and landlord, outside the platform. We charge landlords and businesses only for advertising and subscription services.
8. Maintenance requests
- Maintenance records are an administrative tool for the landlord. Logging an item does not notify us or create any obligation on us.
- Responsibility for repairs, habitability and statutory maintenance duties rests with the landlord, or with the tenant where the lease says so.
- We do not carry out, arrange, supervise, approve or guarantee any repair work.
- Contractors listed in the directory are independent advertisers. We do not employ, appoint, supervise, endorse or guarantee them.
9. Inspections
- Incoming and outgoing inspections are a statutory obligation of the landlord and tenant, not of Rent Direct Hub.
- Any inspection record on the platform is a self-service record created by the landlord.
- We do not attend, conduct, verify or certify inspections and we take no position on their findings.
10. Documents and uploads
- You must have the right to upload each document and to share it with the person you share it with.
- Do not upload more personal information than the purpose requires, and do not upload someone else's identity document without their consent.
- Identity and verification documents are stored privately and are readable only by the uploader and an administrator.
- Stored documents are a convenience, not an archiving or records-management service. Keep your own copies.
- We may remove unlawful content and may be required to disclose records under a lawful request or under PAIA.
11. Rental communications
- Enquiries, WhatsApp handovers, emails and calls between users are their communications, not ours.
- We do not monitor private communications as a matter of course, but we may review reported content for abuse, fraud or unlawful conduct.
- Direct marketing to users must comply with POPIA and the Consumer Protection Act, including consent and opt-out requirements.
- Never share banking details, identity numbers or deposits in response to an unverified message.
12. Agents and other parties
- Rent Direct Hub is designed for direct owners. If you use the platform while acting as a property practitioner or on behalf of an owner, you must say so and you remain responsible for your own regulatory compliance, including the Property Practitioners Act.
- Service providers and advertisers are independent businesses responsible for their own licensing, insurance, tax and workmanship.
- Nothing on the platform creates an agency, partnership, employment or joint-venture relationship between us and any user.
